Welcome to The Icing Diva (the “Service”). These Terms & Conditions (“Terms”) govern your access to and use of the website and application available at https://icingdiva.com/ (the “Site”), operated by Lucinda Larson, The Icing Diva LLC™ (“we”, “us”, “our”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree with these Terms, do not access or use the Service.

5. SMS/Text Messaging Terms

5.1 By opting in to receive SMS messages from The Icing Diva LLC, you agree to receive text messages including alerts, promotions, special offers, and notifications related to our products and services. Message frequency may vary. To stop receiving messages, reply STOP to any text message.

5.2 Message and data rates may apply. Check with your carrier for details.

5.3 Carriers are not liable for delayed or undelivered messages.

6. Disclaimers and Limitation of Liability

6.1 No warranties: The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

6.2 Limitation of liability: To the maximum extent permitted by law, in no event will we (or our directors, officers, employees, agents or affiliates) be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, use, goodwill or other intangible losses, arising out of or related to your use of the Service, regardless of whether we were advised of the possibility of such damages.

6.3 Maximum aggregate liability: Our aggregate liability to you for all claims under or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws from the state of Washington. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bremerton, Washington.

We reserve the right to change these Terms at any time. We will provide notice of material changes via the Site or by other means. Your continued use of the Service after such changes will constitute your acceptance of the revised Terms.
